Terms and Conditions: Online Courses

The “Client” is an individual or organisation that has requested access to the online course as either an individual participant or as a sponsor of a number of participants.
“Product” means collectively the Access, Programme, Certification, Content, Examination, Modules, Server and Reporting as provided by the Website to the client in return for payment made.
“Programme” means the online course selected and paid for by the client.

Registrations and payment

Payment is required before access is given to the chosen Programme, unless registrations are conducted in accordance with a written and signed separate agreement.
In the event of multiple registrations (group participation) over an agreed term, registrations will be undertaken in accordance with that agreement.
Payment may be made by credit card (by telephone or online), bank transfer or cheque. If payment is made by cheque cleared funds are required before access is given to the Programme.
Once payment is received an email containing log on information will be sent to the registered participant.
Each participant must have a unique email address. Only one participant per email address may utilise the Product.
Once registered the participant has access to the programme for a maximum of 6 weeks, unless a written separate agreement states otherwise.

Refund Policy

All refunds are at the discretion of the management.

Completion and de-registration

Once the Programme is completed and the certificate of achievement has been issued the participant will be removed from the server and access to the participant will no longer be available.
Participants’ data will be processed and transferred in accordance with our Privacy statement.

Cancellations and transfers

The full fee is due upon registration. No refunds are given in the event that a registered participant fails to complete the Programme within the access time. No cancellation is permitted once registration to the programme has been completed.
Transfers are allowed to a different participant but an administration fee will be charged (20 UK pounds plus VAT).

Loss of data

Participants must ensure that they follow instructions regarding logging in and exiting the programme. If the participant does not exit correctly, data will not be recorded on the server. This may result in the participant having to retake the programme.

We are unable to issue certification unless the participant’s activity record on the online server confirms satisfactory completion and where an examination has been taken, a pass result.

Liabilities and warranties

The Product is provided “as is” and the Website or its suppliers give Clients no warranty with respect to them. In particular and so far as allowed by law, the Website and its suppliers do not represent or warrant that:
No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Product except to the extent that they are expressly set out in the Terms of a separate agreement.
The Website nor XPair.com accept no liability or responsibility to any person or entity with respect to any loss or damage alleged to have been caused, directly or indirectly, by the information, ideas, opinions or other content of the Products.

  • the Product will meet the Client’s requirements
  • the use of the Product will be uninterrupted, timely, secure or free from error,
  • any information provided will be accurate or reliable, and
  • that defects in the operation or functionality of the Website or it’s suppliers software provided as part of the Product will be corrected.

Intellectual property rights

The Website owns all legal right, title and interest in and to the Product, including any intellectual property rights which subsist in the Product (whether those rights happen to be registered or not, and wherever in the world those rights may exist).
Clients have no right to utilise, copy or obscure any of the Website’s trade names, trademarks, service marks, logos, domain names, and other distinctive brand features.
We aim, to settle all disputes amicably. All agreements for training are governed by the Laws of Monaco.

The purpose of this document is to describe XPair.com’s policy regarding the collection and usage of personal data from hvac-learning web site and from any customer satisfaction or product improvement program in which our customers choose to participate.

How we treat your personal information

XPair.com considers all information collected to be our information. It will be collected from you via the forms in various locations on XPair.com websites and from your voluntary participation in product improvement programs, but will not be shared with, bartered, or sold to any third party.

We collect information from you for the purposes of fulfilling your requests, improving your experience on the XPair.com websites, improving our ability to create individually relevant communications to you about our products and services and improving our products and features to help better solve design problems. XPair.com maintains several e-mail lists to keep interested persons informed about events and other items of interest. Other than disclosing to contractors as required for them to perform specific services for XPair.com, we do not sell, trade, lease, rent, loan or otherwise disclose the addresses on these lists to any third party.


By using our website or by opting into any product improvement program, you consent to the collection and use of your personal information by XPair.com as described in this policy. XPair.com analyzes this information along with data from other program participants to help improve user experience. XPair.com will not collect any personally identifiable data in this process and will not disclose your data collected to any third party without your prior written consent, except to XPair.com’ outside attorneys or as may be required by a court of competent jurisdiction.
